Les Neilson is no longer a New Zealand emergency call operator on 111 in Wellington as he checked up on the background of his potential girlfriends. Mr Neilson said that he will take his case to the Employment Relations Authority as he claims that everyone is doing it and he is being made a scapegoat.

Mr. Nielson was fired in April of this year because of “inappropriate accessing and disclosure of police information.”

Mr. Neilson said: “Many police regularly look up acquaintances and friends on the database. I’ve basically been screwed for doing something that’s a common practice. I’ve used the information the same as everyone else has. If I’m socialising with people and I’m meeting new partners then I need to know the background of those partners because I don’t want to put myself or the department in a compromising position.” He did it “to protect himself and the organisation.”

Mr. Neilson had worked with the New Zealand police for 20 years and has used the background checker “…for the last 20 years.”

However he never sold the information to third parties and never used it for personal gain. “I have not disclosed the information to anyone. I’ve given an explanation. If they investigate it they’ll find out it’s a very legitimate explanation.”

“There’s nothing that says I can’t do that…”

Howard Broad, Police Commissioner, said: “Staff knew it was wrong to access the database for personal use. If they do, it’s wrong and they would know that it’s wrong. It’s quite a clear breach.”

Police can be sued for accessing police information which contain addresses, vehicle details, family, gang links, etc., according to Scott Optican, associate law professor at Auckland University, as it is private information. “The revelation was a significant breach of privacy and police could face lawsuits as well as formal complaints. Police had a duty to investigate how many people had accessed the database for personal use, and what they did with that information. If it looks like there were consequences [for the person who was looked up], they need to contact that person and find out what happened.”

The information regarding name and address is said to be worth between NZ$100 and $200 alone to private investigators and debt collectors.

Mr. Nielson is working as a private investigator in Wellington, the capital of New Zealand.

“How many of the general public would be upset that the local policeman or someone working for the police checks up on them, or who’s in the street, or checks up on potential tenants for flats or aunts’ and uncles’ criminal histories?” Mr. Neilson said.

A spokeswoman for the police headquarters said: “The police organisation is intolerant of any abuses of information that is held. As this case illustrates, action will be taken against any staff member who seeks to use police information for purposes unrelated to their duties.” She would not comment any further due to the case being before the Employment Relations Authority.

Greg O’Conner, president of the Police Association, said that their union had reminded members to be aware of their use of police information and facilities. “Operation Insider, which investigated the distribution of pornographic e-mails among police, had highlighted the importance of using such facilities appropriately.”

“Quite frankly, I think the police should explain to members of the public exactly what happened here and what they’ll do to make sure it doesn’t happen again,” Mr. Optican said.

European Court of Justice says Facebook must remove ‘illegal’ posts globally

On Thursday, the European Court of Justice (ECJ) — the supreme court on matters of European Union (EU) law — ruled in regard to the case “Eva Glawischnig-Piesczek vs. Facebook Ireland Limited”. The Luxembourg-based court issued a judgement favorable to the plaintiff, Eva Glawischnig-Piesczek, a politician in Austria, allowing an Austrian court to require social media site Facebook to remove a post from its site made by a user in Ireland. The ruling made proclamations which analysts say could have far-reaching implications for regulation of content on the Internet beyond the borders of the EU. The court’s decision cannot be appealed.

In 2016, a Facebook user registered from Ireland shared publicly a news article from the Austrian news site oe24.at along with some comments of their own. The post, which was about Eva Glawischnig-Piesczek, the then chair and spokesperson for The Greens, could potentially be seen by anyone with access to Facebook. The comments called her political party facsist and termed her a “corrupt oaf” and a “lousy traitor”.

Glawischnig-Piesczek sued in Austria for defamation and won. Facebook was ordered to remove the post which it did by making it unavailable to view in Austria only. This apparently did not appease Glawischnig-Piesczek. As a result, the Supreme Court of Justice (Oberster Gerichtshof?) of Austria brought the case before the ECJ, asking for clarifications of EU law.

The EU law Electronic Commerce Directive 2000 provides liability protections for hosting sites. In its finding, the ECJ set rules for compliance with rulings from a court from any EU member nation for any website which hosts user content:

By today’s judgment, the Court of Justice answers the Oberster Gerichtshof that the Directive on electronic commerce, which seeks to strike a balance between the different interests at stake, does not preclude a court of a Member State from ordering a host provider:

  • to remove information which it stores, the content of which is identical to the content of information which was previously declared to be unlawful, or to block access to that information, irrespective of who requested the storage of that information;
  • to remove information which it stores, the content of which is equivalent to the content of information which was previously declared to be unlawful, or to block access to that information, provided that the monitoring of and search for the information concerned by such an injunction are limited to information conveying a message the content of which remains essentially unchanged compared with the content which gave rise to the finding of illegality and containing the elements specified in the injunction, and provided that the differences in the wording of that equivalent content, compared with the wording characterising the information which was previously declared to be illegal, are not such as to require the host provider to carry out an independent assessment of that content (thus, the host provider may have recourse to automated search tools and technologies);
  • to remove information covered by the injunction or to block access to that information worldwide within the framework of the relevant international law, and it is up to Member States to take that law into account.

According to the ruling, a host, such as Facebook, must remove the original post as well as re-posts and posts which state essentially the same thing if it is deemed against the law. Steve Peers of the University of Essex, speaking to BBC, said, “If there’s a court order to say that someone’s been defamed, then Facebook has to also search for different variations of it”, also observing, “[t]here’s no harmonised defamation law internationally”.

Jennifer Daskal of American University and contributor to Slate wrote, “a single EU country (in this case Austria) could demand an online provider (in this case Facebook) to take down an objectionable post, monitor its site for equivalent content, and take down those postings as well. And it says a country could do so on a global scale, regardless of where the poster or the viewer is located. In so ruling, the court demonstrated a shocking ignorance of the technology involved and set the stage for the most censor-prone country to set global speech rules.”

Facebook released a statement which read, in part, “This judgment raises critical questions around freedom of expression and the role that internet companies should play in monitoring, interpreting and removing speech that might be illegal in any particular country”. Facebook further claimed, “It undermines the long-standing principle that one country does not have the right to impose its laws on speech on another country”.

Canadian TD Financial Group has come to a deal with the regional U.S. bank, Hudson United Bancorp, to buy Hudson for US$1.9 billion. The new addition will be folding into itsMaine-based TD Banknorth, which is 51% owned by TD Financial. The acquisition will bring in 204 new branches and increase TD’s footprint to New Jersey, New York, Connecticut and Pennsylvania. In total this will give TD 590 branches, 751 banking machines and more than US$26-billion in deposits across eight northeastern states.

Hudson specialises in commercial real estate, consumer and credit card loans to individuals and businesses. The bank also had $8.85 billion US in assets at the end of it’s first quarter, on March 31. The company’s shares had been dropping in the course of the past year because of allegations of money-laundering violations and after an earnings warning, making it a good steal for TD. The acquisition will greatly increased TD’s influence in America.

This continues the recent trend for Canadian banks expanding into the U.S. where regulation on bank mergers is less strict than in their home country.

“This transaction delivers on our shared vision for growth and marks a significant milestone in TD Banknorth’s expansion strategy,” TD Bank CEO and president Ed Clark said in a statement.

With two space walks, 78 million miles and six months on board the International Space Station under their belts, Commander-Science Officer Leroy Chiao and Flight Engineer Salizhan Sharipov, the station’s 10th crew, landed in Kazakhstan in a Soyuz spacecraft at 6:08 p.m. EDT Sunday.

Also returning was European Space Agency Astronaut Roberto Vittori of Italy, who launched to the Station with the Expedition 11 crew and spent eight days doing experiments. He was aboard under a contract between ESA and the Russian Federal Space Agency.

The re-entry of the ISS Soyuz 9 spacecraft was perfect, returning the astronauts to Earth 53 miles northeast of the town of Arkalyk after 192 days, 19 hours and 2 minutes in space for the Expedition 10 crew. The recovery team reached the capsule in minutes.

They launched from the Baikonur Cosmodrome in Kazakhstan last Oct. 13 at 11:06 p.m. EDT. During their increment they performed two spacewalks, continued station maintenance and did scientific experiments.

Notable accomplishments included replacing critical hardware in the Joint Quest Airlock; repairing U.S. spacesuits; and submitting a scientific research paper on ultrasound use in space. Chiao was also the first astronaut to vote in the U.S. Presidential election from space. The crew completed two spacewalks, including experiment installation and tasks to prepare the Station for the arrival of the new European Automated Transfer Vehicle next year.

Aboard the Station, Commander Sergei Krikalev and Flight Engineer and NASA Station Science Officer John Phillips, the Expedition 11 crew, are beginning a six-month mission. It will include the resumption of Space Shuttle flights and two spacewalks from the Station. Expedition 11 is scheduled to return to Earth on October 7, 2005. The two latest occupants of the station launched with Vittori from Baikonur April 14.

Krikalev and Phillips will have light duty for the next two days, as they rest after completing a busy handover period. For the past week, they have been learning about Station operations from the two men who called the ship home since October. Chiao and Sharipov briefed Krikalev and Phillips on day-to-day operations and gave them hands-on opportunities at Station maintenance. Chiao and Phillips restored the Quest airlock to working order for future spacewalks and practiced operating the Canadarm2 robotic arm.

In early May, Wikinews extended an invitation to Vitaly Filipchenko, an independent candidate in the 2021 New York City mayoral election, set to take place November 2nd, alongside other candidates. Filipchenko answered some questions about his policies and campaign during a phone interview.

Filipchenko, registered on the New York City Campaign Finance Board as Vitaly A. Filipchenko, is the first Russian candidate for New York City mayor, being born in Tomsk, Siberia in 1973, according to news agency Sputnik. He has since naturalised as a United States citizen. According to the web site, Filipchenko has been educated in road construction and maintenance and owns a moving services company; he describes himself on his web site as a “small business owner”. On his web site’s platform page, he says that “[m]y English may not be perfect – but my platform is.”

Incumbent Democrat mayor Bill de Blasio, who won re-election in the 2017 New York City mayoral election by 66.5%, cannot run for a third term under term limits. As of April 28, 22 candidates are currently running, the majority of whom are also Democrats. Ahead of the June Democratic primary for New York City mayor, a poll conducted May 23 and 24 by WPIX and Emerson College of 12 Democratic candidates with a margin of error of 3.2 per cent has former commissioner for the New York City Department of Sanitation Kathryn Garcia and Borough President of Brooklyn Eric Adams leading with 21.1% and 20.1%, respectively.

With two by-elections coming up in Australia, many minor parties and independents will be looking to gain a seat in the House of Representatives. Stephen Murphy is one of the independents.

Mr Murphy is a computer programmer from the Melbourne suburb of Brunswick.

“After growing up in South-East Melbourne I studied Science at Monash with first class Honours, worked in Europe for 10 years and have recently returned to Australia. I work in finance as a computer programmer and speak five languages,” Mr Murphy said.

Wikinews reporter Patrick Gillett held an exclusive email interview with Mr Murphy, candidate for the Division of Higgins.

((WN)) Why do you want to get into parliament?

Stephen Murphy: I am standing up for what I believe is the correct course of action on the biggest issue in Australian politics in 100 years – Kevin Rudd’s flawed emissions trading scheme (ETS).

((WN)) What would the three main policies you are taking into this by-election be?

SM: I will oppose the emissions trading scheme, ensure that all government policy is based on accurate scientific evidence and return common sense to Canberra

((WN)) How would you address these policies?

SM: By asking for a Royal Commission into climate change so that the facts (such as that global warming stopped in 2001 and the emissions trading scheme will not change the climate one bit) are openly presented to the Australian people.

((WN)) Sending asylum seekers to Indonesia: good or bad?

SM: Any government policy that does not properly consider all implications (be it emissions trading, or any other issue) is a bad one.

((WN)) Is the Australian dollar’s near parity with the US dollar a sign that the Australian economy is healthy, the US economy in chaos or both?

SM: It’s a sign of both. Many countries around the world look with envy at how well (relatively) Australia is doing, to our credit! It is of concern that the American economy is in such bad shape and that their levels of debt seem unsustainable.

((WN)) How do you rate the governments economic stimulus package?

SM: The economic stimulus package was poorly targeted and poorly carried out. When we could have been building roads, dams, railways and hospitals yet instead we were paying for tattoos, PlayStations and overseas holidays.

((WN)) Should it be wound back?

SM: The question about levels of stimulus spending is a complicated one and requires expertise in economics, however one could say in general terms that all government spending should be well targeted and spent in the most efficient way.

((WN)) Is Kevin Rudd a better Prime Minister than John Howard?’

SM: Australian voters are the best judge of that and we will know in 2019 🙂

((WN)) Is the Carbon Pollution Reduction Scheme an effective solution to climate change? Why?

SM: Absolutely not. The CPRS will not change the climate by any amount that we can measure – it’s just a new tax that will hurt Australians and drive businesses and jobs overseas. Since 2003 there has been mountains of new scientific data which contradicts the popular theory that human carbon dioxide emissions are causing significant global warming. Recently, many of the scientists who wrote the IPCC report (on which the ETS / CPRS is based) have been reported as manipulating scientific data to create scary global warming scenarios. The science is definitely not settled

((WN)) Is there a better solution?

SM: We can very easily refocus the momentum and goodwill that has been generated on climate change and channel this energy into other worthwhile environmental projects in Australia that will make a difference.

((WN)) Why should the electorate vote for you?

SM: I will oppose the ETS and support responsible environmental policies instead of radical environmental policies that could end up costing every Australian taxpayer $4550 per year in new taxes.

Stephen Harper, Canada’s Prime Minister, apologized on behalf of the Canadian Government for its role in the Indian Residential School System in front of Aboriginal Leaders, elders, and more than 1000 outside the Parliament Building. Harper proclaimed, “The treatment of children in Indian residential schools is a sad chapter in our history. Today, we recognize that this policy of assimilation was wrong, has caused great harm, and has no place in our country.” This apology was seen at more than 30 event around the country, and broadcast live on CBC Newsworld and CTV Newsnet.

The residential school system was created based on the Gradual Civilization Act (1857) and the Gradual Enfranchisement Act (1869), which assumed the superiority of British Ways, prompting the need for Aboriginals to become “civilized” by becoming English-speakers, Christians, and farmers. The funding of the schools was provided by the Indian Act (1876) and by the federal government department, Indian and Northern Affairs Canada, and operated with the support of churches, generally the Roman Catholic Church and the United Church of Canada.

In the 1920s, attendance became compulsory for all children aged 6 to 15, and families who refused to cooperate were at risk of having the children removed by the government, and the parents sent to prison. The school systematically tried to destroy the aboriginal language and way of life, raising the idea of cultural genocide. Students were forbidden to speak their native languages, even outside the classroom, as to install the English or French language (and as result, to “forget” their native language), punishable by unreasonably severe corporal punishment. Practicing non-Christian faiths was also punishable by corporal punishment.

In the late 1990s, allegations of sexual abuse, as well as several physical and psychological abuse, arose, leading to large monetary payments from the federal government and churches to former students. The government also established the Aboriginal Healing Foundation, providing $350 million to fund community-based healing projects, and provided another $40 million in 2005.

On February 13, 2008, Australian Prime Minister Kevin Rudd made a similar apology in the Australian House of Parliament.

On June 21, 2008, Indian Residential School Museum of Canada is scheduled to open on Long Plain First Nation, near Portage La Prairie, Manitoba.
